Recent Successes

  • A multi-count civil RICO action in Connecticut federal court against a corrupt medical provider involving medical and statistical experts. This case presents the issue of an insurer's ability to recover losses incurred in connection with payments to innocent third parties caused by medical provider fraud.
  • A Chapter 13 Bankruptcy case in Rhode Island in which Smith & Brink's client prevailed at the Bankruptcy Court and intermediate appellate review on the issue of whether an as-of-yet unlitigated RICO claim against the debtor constitutes a "liquidated" and "non-contingent" debt required to be included in the calculation of a debtor's Chapter 13 eligibility.
  • Obtained judgments in excess of $1 million dollars against all principal defendants in a multi-count federal racketeering litigation in Nevada federal court against a corrupt insurance company insider and his co-conspirators (a lawyer, an accountant and an outside adjuster).
  • Obtained a multi-million dollar judgment against an insurance company insider and his co-conspirator in a civil RICO action brought in Rhode Island federal court.
  • Obtained judgments in excess of $300,000.oo in a multi-count federal racketeering action in Massachusetts federal court against a corrupt auto body business, its principal owner and associated conspirators.
